Resumo

Resumo: Toma-se como discussão a postura do Poder Judiciário no sentido de proceder para a concretização da Constituição Federal de 1988 com a incorporação das reivindicações sociais, como forma de resolução de conflitos a partir da sociedade aberta, plural e democrática proposta por Peter Häberle. Para tanto, passa-se pela crítica ao positivismo jurídico, à nova hermenêutica, com enfoque no seu método hermenêutico concretizador. A escolha deve-se pelo fato deste impor o processo alargado de interpretação da Constituição, em que todas as camadas da sociedade podem ser intérpretes da norma, não apenas monopólio dos intérpretes jurídicos. O pensador alemão da Nova Hermenêutica adota o método hermenêutico concretizador que aborda a leitura do texto normativo, iniciando-o a partir da pré-compreensão do intérprete. Uma leitura da realidade vivida e do problema concreto, os quais dão ao intérprete um papel criador na obtenção do sentido do texto normativo. Neste processo interpretativo em que integra a realidade, alia-se teoria e prática social.

Abstract: Take as discussion posture of the judiciary in order to proceed to the implementation of the Federal Constitution of 1988 with the incorporation of social demands as a form of conflict resolution from the open society, plural and democratic proposal by Peter Häberle. Therefore, going by the criticism of legal positivism, the new hermeneutics, focusing on his hermeneutical method concretizing. The choice is due to the fact that this impose wide ranging interpretation of the Constitution, where all strata of society can be interpreters of the standard, not only monopoly for legal interpreters. The German thinker of the New Hermeneutics adopts concretizing hermeneutical method that addresses the reading of the normative text, starting from the pre-understanding of the interpreter. A reading of lived reality and the real problem, which give the interpreter a creative role in getting the meaning of the legal text. In this interpretive process that integrates the reality, joins social theory and practice.
